End-User License Agreement (EULA)

This End-User License Agreement ("Agreement") is a legal agreement between you and Codvia Teknoloji A.Ş. ("Licensor") for the Ubica mobile application ("Software").

1. License Grant

Licensor grants you a personal, non-exclusive, non-transferable, limited license to install and use the Software on a mobile device that you own or control, solely for your personal, non-commercial use in accordance with this Agreement.

2. Prohibited Actions

You shall not: (a) copy the Software; (b) modify, translate, or create derivative works of the Software; (c) decompile, reverse engineer, or disassemble the Software; (d) rent, lease, lend, sell, or sublicense the Software; or (e) use the Software for any unlawful purpose, specifically including unauthorized tracking of individuals.

3. Intellectual Property

The Software and all copyrights, trademarks, and other intellectual property rights therein are the sole property of Licensor. You acknowledge that no title to the intellectual property in the Software is transferred to you under this Agreement.

4. Consent to Use of Data

You agree that Licensor may collect and use technical data and related information to facilitate the provision of software updates, product support, and other services. Use of your data is governed by our Privacy Policy.

5. Termination

This Agreement is effective until terminated by you or Licensor. Your rights under this license will terminate automatically without notice if you fail to comply with any term of this Agreement.

6. Disclaimer of Warranties

THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND. LICENSOR DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

7. Limitation of Liability

TO THE EXTENT NOT PROHIBITED BY LAW, IN NO EVENT SHALL LICENSOR BE LIABLE FOR PERSONAL INJURY, OR ANY INCIDENTAL, SPECIAL, INDIRECT, OR CONSEQUENTIAL DAMAGES WHATSOEVER ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SOFTWARE.

8. Apple-Related Terms

If you downloaded the Software from the Apple App Store, you acknowledge that this Agreement is between you and Licensor only, and not with Apple. Apple has no obligation to provide maintenance or support for the Software. In the event of any failure of the Software to conform to any applicable warranty, you may notify Apple for a refund of the purchase price.
